Terms of Service

These Terms of Service ("Terms") govern your access to and use of DARASA (the "Service"), a teacher productivity platform provided by Vertex Tech Solutions ("we", "us", "our"). By creating an account or using DARASA, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who Can Use DARASA

DARASA is built for teachers and school staff. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.

2. What DARASA Is For

DARASA helps teachers manage classes, gradebooks, lesson planning, timetables, teaching resources, class attendance, and communication with parents, and offers AI-assisted marking and exam generation tools. It is provided as a productivity aid — you remain responsible for verifying grades, AI-generated content, and any decisions made using information from the Service before relying on them for official school records or communications.

3. Your Account

You are responsible for all activity that happens under your account. Notify us immediately at support@reply.darasa.site if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, are used for unlawful purposes, or where we reasonably believe continued access poses a risk to the Service or other users.

4. Subscriptions, Trial, and Payment

• New accounts receive a 7-day free trial with full access to all features. No payment is required to start a trial.
• After the trial, continued full access requires a paid subscription: Ksh 450/month, Ksh 1,150/term, or Ksh 3,100/year. Without a subscription, your account moves to the free Standard tier, which offers limited access (viewing your classes and student list, and adding students).
• Payments are currently accepted via M-Pesa, Airtel Money, or bank transfer, and are verified manually. Submitting a subscription request does not immediately grant Premium access — access is granted once your payment is confirmed.
• Subscriptions do not renew automatically. You may submit a new subscription request at any time to extend or renew your access.
• Refunds: Because plans are activated manually after payment confirmation, we do not offer refunds for change of mind once a subscription period has started. If you believe you were charged in error or experienced a billing issue, contact us at support@reply.darasa.site or +254 751 936947 and we will review it in good faith.

5. Your Content and Student Data

You retain ownership of the information you enter into DARASA, including class lists, student records, marks, lesson plans, and uploaded files. When you enter information about your students (such as names, admission numbers, parent contacts, medical notes, or attendance), you confirm that you are authorized by your school to record and manage this information, and that doing so complies with your school's own data policies and applicable law. We process this data on your behalf, as described in our Privacy Policy.

6. AI Features

DARASA's AI Marking and exam generation tools use third-party AI models to process content you upload or provide (such as exam papers). AI-generated marking schemes, extracted text, and generated questions may contain errors and should always be reviewed by you before use. Do not upload personally identifying student information as part of exam content where it is not necessary.

7. Acceptable Use

You agree not to:

• Use DARASA for any unlawful purpose or to violate anyone's rights;
• Attempt to gain unauthorized access to other accounts, our systems, or data you don't own;
• Upload malicious files or attempt to disrupt the Service;
• Use the Service to harass, discriminate against, or harm students, parents, or colleagues;
• Resell or redistribute the Service without our written permission.

8. Service Availability

We aim to keep DARASA available and reliable, but we do not guarantee uninterrupted access. The Service is provided "as is" and "as available." Core features work offline using local device storage and sync when a connection is available, but this does not guarantee data will never be lost, especially if a device is lost, damaged, or its local storage cleared before a sync completes.

9. Limitation of Liability

To the fullest extent permitted by law, Vertex Tech Solutions will not be liable for indirect, incidental, or consequential damages arising from your use of DARASA, including loss of data, loss of income, or reliance on AI-generated content. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time as the Service evolves. Continued use of DARASA after changes take effect means you accept the updated Terms. We will update the "Last updated" date above when changes are made.

11. Governing Law

These Terms are governed by the laws of Kenya.
